1. Agreement

By accessing or using the Gamma platform operated by Gamma Theta ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Description of service

Gamma is a multi-tenant agentic SaaS platform that enables businesses to deploy AI agents for lead qualification, appointment scheduling, and client communication via WhatsApp Business API.

3. Eligibility

You must be at least 18 years old and authorised to enter into binding contracts on behalf of your organisation to use this platform. By using Gamma you represent that these conditions are met.

4. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of applicable law
  • Send spam, unsolicited messages, or content that violates WhatsApp's policies
  • Attempt to gain unauthorised access to any part of the platform or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Use the platform to store or transmit malicious code

5. WhatsApp and Meta compliance

Use of this platform is contingent on compliance with Meta's WhatsApp Business Policy and all applicable Meta platform policies. You are solely responsible for ensuring your use of WhatsApp messaging through Gamma complies with these policies.

6. Data and privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual property

All intellectual property rights in the Gamma platform, including software, design, and content, are owned by Gamma Theta. You are granted a limited, non-exclusive, non-transferable licence to use the platform for your internal business purposes.

8. Limitation of liability

To the maximum extent permitted by law, Gamma Theta shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total liability for any claim shall not exceed the amounts paid by you in the 3 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your access to the platform at any time for violation of these Terms or for any other reason at our discretion, with or without notice.

10. Changes to these terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
