What is a RERA complaint?

Under Section 31 of the RERA Act, any aggrieved homebuyer can file a complaint against a builder (promoter), agent or allottee for breaching the Act — most commonly for delayed possession, refund refusal, false promises or deficient construction. RERA created dedicated regulatory authorities and a special tribunal so buyers no longer have to fight developers only through slow civil courts.

First, which RERA covers your project?

This trips up many Delhi-NCR buyers. Your complaint must go to the RERA of the state where the project is physically located, not where you live:

What can you claim under RERA?

For a delayed or defaulting project, RERA gives you a choice of remedies, mainly under Section 18:

  • Refund with interest — if you want to exit, the builder must return your money with interest for the whole period it was held;
  • Possession with interest for the delay — if you want to keep the flat, the builder pays interest for every month of delay until you get possession;
  • Compensation — for loss caused by false or misleading information, structural defects or other breaches, decided by the Adjudicating Officer.

How to file a RERA complaint in Delhi (step by step)

  • Confirm the correct authority using the table above, and check that the project is RERA-registered.
  • Create an account on the relevant RERA portal (for a Delhi project, the Delhi RERA portal).
  • File the complaint in the prescribed form (Form and fee are set by each state's RERA rules), clearly stating the facts, the breach and the relief you seek.
  • Attach your documents — allotment letter, builder-buyer agreement, all payment receipts, and correspondence with the builder.
  • Pay the prescribed complaint fee and submit.
  • Attend the hearings — the Authority (or Adjudicating Officer) hears both sides and passes a reasoned order.

Authority or Adjudicating Officer — which one?

Under Section 31 you can approach either. Broadly, the Authority deals with directions to comply with the Act (refund, interest, project directions), while the Adjudicating Officer — who holds the rank of a District Judge — decides claims for compensation. A developer wanting to appeal a payment order usually has to deposit a percentage of the amount first, which discourages frivolous appeals.
